ANK successfully represented Ukrferry at the Supreme Court

ANK team of attorneys protected the interests of the LLC Shipping company Ukrferry at the Supreme Court, which has recently examined the case on recovering losses under the state property lease agreement.

In April 2021 the State Property Fund of Ukraine submitted a claim to the court with request to recover UAH 47,8 million from LLC Ukrferry as alleged losses arising from the state property lease agreement. According to the judgements of the first and appeal instances, the claim of the State Property Fund has been dismissed in full. Notwithstanding to the judgements of the lower courts, the Fund submitted the cassation appeal to the Supreme Court, where requested to cancel both judgements and issue the new judgement, whereby satisfy the claim in full and recover from LLC Ukrferry the losses in the amount of UAH 47,8 million.

The team of ANK attorneys have drafted the Statement of Defense and written explanations on the case, which have been taken into account by the panel of judges. As a result of revising the case in cassation instance, the Supreme Court has declined the cassation appeal of the State Property Fund and remained judgements of the first and appeal courts unchanged.
